MOLD LEGAL PROBLEMS AND MOLD INSURANCE FRAUDS

Mold Legal Problems and Insurance Frauds

Legal information, law information, legal questions, legal help and legal advice about the several ways insurance companies and insurance adjusters perpetrate mold frauds. This legal information, law information, legal advice, legal help, and legal answers to legal questions and legal problems about mold insurance as well as other mold-related legal questions, legal problems, legal information, law information, legal advice appeared through the courtesy of www.moldinspector.com

Here are several cases mold-related insurance frauds perpetrated by insurance companies and insurance adjusters:

  1. Hiring incompetent, low-paid, company-stooge testing personnel to do the least possible mold testing in the least likely mold-locations in an insured's property so that any actual mold is NOT likely to be discovered.

  2. Utilizing ineffective Air-O-Cell mold testing media so that little or no mold will be discovered. Air-O-Cell cassettes test too small of an air sample to give a truly accurate insight into a property's real mold infestation problems. Direct sampling of visible molds and mold culture plates are vastly superior to Air-O-Cell technology in determining the extent of mold problems in a property and in identification of the molds present.

  3. If the testing stooges uncover any mold problems, the serious mold test results are not to be shared with the insureds and are to be kept a complete secret forever from the insureds. This common insurance company fraud is one of the causes of actions in the $20 million Ed McMahon lawsuit against his homeowner's insurance company and its two insurance stooge testing and remediation companies. The McMahon defendants kept secret mold test results showing a serious mold infestation in the McMahon residence of the deadly mold Stachybotrys.

  4. Telling insureds that there is no mold insurance coverage even though there is evidence that insurance-covered water damage is the direct cause of the resulting mold infestation.

Question: I purchased the condo of my dreams in Columbia Shores Vancouver , Washington. I soon became very ill. I found it was from being exposed to mold. Farmers Insurance has established the presence of Pennicillium, Cladissporuim, Aspergillis versa color, and Stackybotriuos (sp) in the ceiling trusses, floor joists, and common wall.

I am unable to fix common areas, I can not seem to get Farmers Insurance to fix the mold. I have become so sensitized I must move from my home town. I was born here, my children and grandchildren were born here.

I must leave my Family, my friends, my job, and retirement... I can not live in the condo nor sell it because of the mold. I am a teacher and can not continue to spend $1500 per month for this albatrouse. Can You help me?????????

Answer: First of all my condolences to you for having such a nightmare situation with mold. You need to have your possible legal claims against the condo seller, realtor, condo association, mortgage lender (if any), and insurance company reviewed and analyzed by an experienced environmental or mold attorney. You can find a good lawyer or attorney in the mold lawyer directory at http://www.moldlawyer.com.

Before you see a prospective attorney, it is important that you have paid for your own in-depth inspection and mold testing of your condo, condo HVAC equipment and ducts, and the condo commons area touching your condo.

It is very likely that an independent inspection by a Certified Mold Inspector (http://www.moldprofession.com);will uncover and document a much bigger mold problem than was found in insurance company-paid mold testing of your condo.

  Attention: Landlords!

If you have mold legal problems as well as mold legal questions, visit: moldlawyer.com. This mold legal information website provides important legal information, law information, legal help, legal advice and answers to your legal questions and legal problems regarding mold-related complaints filed against you by your tenants, plus information on where and how to contact a reputable mold lawyer or attorney.  Make sure to read the legal question and answer portion of the website; it contains useful legal information, legal advice, legal help as well as law information regarding mold legal problems, mold legal disputes and litigations.

Many mold inspectors who do work for insurance companies know that they are being paid NOT to find mold infestation, whereas a Certified Mold Inspector does a very thorough inspection and testing job solely on your behalf to find out the real truth about any mold problems that your condo and condo building may have. Ask your new mold attorney whether he or she should seek on your behalf a written moratorium on your mortgage payments while you are working on removing and remediation of the mold problems of your condo.

A condo that is heavily mold-contaminated is not only worthless as loan collateral to your condo lender, but it is also a source of potential legal liability on the part of the lender for its having possibly negligently financed the sale of the moldy condo to you. Your new attorney will review the mold testing results from both the insurance company and your private Certified Mold Inspector mold report to determine what legal rights, if any, you have under your state law against the various possible defendants.
